{"id":2824,"date":"2018-02-14T14:49:55","date_gmt":"2018-02-14T13:49:55","guid":{"rendered":"https:\/\/www.jurati.de\/detention-pending-deportation\/"},"modified":"2026-04-24T19:27:33","modified_gmt":"2026-04-24T17:27:33","slug":"detention-pending-deportation","status":"publish","type":"page","link":"https:\/\/www.jurati.de\/en\/migration-law\/detention-pending-deportation\/","title":{"rendered":"Detention pending deportation"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_custom_heading text=&#8221;Detention pending deportation&#8221; google_fonts=&#8221;font_family:Lora%3Aregular%2Citalic%2C700%2C700italic|font_style:400%20regular%3A400%3Anormal&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]If a foreigner is obliged to leave the Federal Republic of Germany and is to be <a href=\"https:\/\/www.jurati.de\/migrationsrecht\/abschiebung\/\">deported<\/a>, the foreigners authority can obtain a <b>detention order<\/b> from the local court under certain conditions.<\/p>\n<p>For example, the court can order detention if<\/p>\n<ul>\n<li>the foreigner did not appear at an announced deportation date<\/li>\n<li>there are reasonable grounds to suspect that the foreign national intends to evade <a href=\"https:\/\/www.jurati.de\/migrationsrecht\/abschiebung\/\">deportation<\/a> <\/li>\n<\/ul>\n<p>The <strong>formal requirements<\/strong> for an application for detention are quite high, so that an order may have been issued unlawfully.<\/p>\n<p>Detention pending deportation is permitted for a maximum of <b>6 months<\/b> and can be extended to 18 months if the deportation cannot take place for reasons for which the foreigner is responsible.<\/p>\n<p>If the immigration authorities plan to arrest a person, they are generally obliged to apply for a <b>court order<\/b> beforehand. After arrest, the person concerned must be brought before the judge <strong>as soon as possible<\/strong>, who will decide on further detention.<\/p>\n<p>In addition to the question of whether detention pending deportation is permissible, it is often a question of whether <a href=\"https:\/\/www.jurati.de\/migrationsrecht\/abschiebung\/\">deportation<\/a> to the home country can be prevented. Parallel to the detention proceedings, an attempt would have to be made to obtain <a href=\"https:\/\/www.jurati.de\/migrationsrecht\/duldung\/\">toleration<\/a> from the administrative court. In individual cases, this may result in the detention period being extended.<\/p>\n<p>If there is no prospect of <a href=\"https:\/\/www.jurati.de\/migrationsrecht\/duldung\/\">toleration<\/a>, an attempt can be made either to have a detention order revoked, e.g. in <b>appeal proceedings<\/b>, or to negotiate release from detention on presentation of a ticket home in order to shorten the period of detention.
