It is usually issued after five years of legal residence. The most important prerequisites for obtaining a settlement permit are the forecast of a secure <strong>livelihood<\/strong>, sufficient contributions to <strong>pension insurance<\/strong> and <strong>knowledge of the German language and legal system<\/strong> (language skills B1 and naturalization test).<\/p>\n<p>There are numerous <strong>special regulations<\/strong>:<\/p>\n<ul>\n<li>If you are <strong>married<\/strong> to a <strong>German citizen<\/strong> or are the parent of a minor German child, you can obtain a settlement permit after just three years.<\/li>\n<li>If your spouse is in possession of a settlement permit as a skilled worker and you are gainfully employed yourself, a shorter period of three years also applies.<\/li>\n<li>As a <strong>recognized refugee<\/strong> under the Geneva Refugee Convention, there are simplifications with regard to language skills, securing a livelihood and pension insurance contributions.<\/li>\n<li>If you are in possession of an <a href=\"https:\/\/www.jurati.de\/en\/migration-law\/eu-blue-card\/\"><strong>EU Blue Card<\/strong><\/a> you can obtain a settlement permit after just 21 months (with B1 language skills) or after 27 months (with basic A1 language skills).<\/li>\n<li>For graduates <strong>of German universities<\/strong> or German vocational training who are employed as skilled workers, a period of 2 years applies (Section 18c (1) AufenthG).<\/li>\n<li>For <strong>skilled workers<\/strong> with recognized foreign vocational training, the time is reduced to 3 years.<\/li>\n<\/ul>\n<p>The following overview shows the different conditions for granting in detail:<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-3708 size-full\" src=\"https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/04\/NEEng.jpg\" alt=\"\" width=\"1912\" height=\"1075\" srcset=\"https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/04\/NEEng.jpg 1912w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/04\/NEEng-300x169.jpg 300w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/04\/NEEng-1024x576.jpg 1024w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/04\/NEEng-768x432.jpg 768w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/04\/NEEng-1536x864.jpg 1536w\" sizes=\"auto, (max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-4086 size-full\" src=\"https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/NE-humanitaere-Aufenthalte-und-Kinder.jpg\" alt=\"Niederlassungserlaubnis f\u00fcr humanit\u00e4re Aufenthalte und Kinder\" width=\"974\" height=\"738\" srcset=\"https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/NE-humanitaere-Aufenthalte-und-Kinder.jpg 974w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/NE-humanitaere-Aufenthalte-und-Kinder-300x227.jpg 300w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/NE-humanitaere-Aufenthalte-und-Kinder-768x582.jpg 768w\" sizes=\"auto, (max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/p>\n<h3>EU long term residence permit (Erlaubnis zum Daueraufenthalt-EU)<\/h3>\n<p>The EU long term residence permit (\u00a7 9a AufenthG) is a residence title that is very similar to the settlement permit in terms of requirements and rights. However, it can only be issued after a lawful <strong>stay of five years<\/strong>.<\/p>\n<p>The EU long term residence permit offers two significant advantages over the settlement permit, so it should be <strong>applied for as a priority<\/strong>:<\/p>\n<ul>\n<li><strong>Onward migration to other EU countries:<\/strong> With a German EU long term residence permit, you can move on to other EU countries (except Ireland and Denmark) under certain conditions.<\/li>\n<li><strong>More generous expiry regulations:<\/strong> For longer periods of absence from Germany, the title expires much later than a settlement permit.<\/li>\n<\/ul>\n<h3><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-4085\" src=\"https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/Unterschiede-Niederlassungserlaubnis-DaueraufenthaltEU.jpg\" alt=\"different rights for Niederlassungserlaubnis and EU Long Term Residency\" width=\"952\" height=\"717\" srcset=\"https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/Unterschiede-Niederlassungserlaubnis-DaueraufenthaltEU.jpg 952w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/Unterschiede-Niederlassungserlaubnis-DaueraufenthaltEU-300x226.jpg 300w, https:\/\/www.jurati.de\/wp-content\/uploads\/2026\/05\/Unterschiede-Niederlassungserlaubnis-DaueraufenthaltEU-768x578.jpg 768w\" sizes=\"auto, (max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/>Residence permit according to \u00a7 38a AufenthG &#8211; holder of a foreign EU long term residence permit<\/h3>\n<p>If you have an <strong>EU long term residence permit issued by another EU member state<\/strong> (e.g. Italian <em>soggiornante di lungo periodo &#8211; UE<\/em>), you are not allowed to reside or work in Germany permanently. However, you can apply for a German <strong>residence permit in accordance with \u00a7 38a AufenthG<\/strong>.<\/p>\n<p>This will be granted if your livelihood is secured. In order to take up employment, the immigration authority must obtain the <strong>approval of the Federal Employment Agency<\/strong>, which is granted if the working conditions are in line with local standards &#8211; you will need a specific employment contract for this.
