We check whether you are entitled to family reunification and guide you through the visa and residence procedure.<\/p>\n<h3>Who can apply?<\/h3>\n<p>Family reunification is generally possible for the nuclear family:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li>underage children<\/li>\n<li>Parents to minor children<\/li>\n<\/ul>\n<p>For other family members (e.g. parents to adult children), reunification is only possible in a few exceptional cases.<\/p>\n<h3>Spousal reunification<\/h3>\n<p>In many cases, it is possible for a spouse to join you &#8211; in particular, German nationals are generally entitled to do so.<\/p>\n<p>Typical requirements are<\/p>\n<ul>\n<li>Proof of basic German language skills (A1)<\/li>\n<li>Effective marriage<\/li>\n<li>Entering the country with the correct visa<\/li>\n<\/ul>\n<p>When joining a foreign spouse, the livelihood must also be secured.<\/p>\n<p>When joining a German spouse, a certain minimum income is generally not required.<\/p>\n<h3>Reunification of children<\/h3>\n<ul>\n<li>Generally possible up to the age of 16<\/li>\n<li>Up to the age of 18 only under certain conditions (e.g. C1 language skills or reunification with skilled workers)<\/li>\n<\/ul>\n<p>As a rule, reunification presupposes that a family partnership is to be established.<\/p>\n<h3>Reunification of parents<\/h3>\n<p>The reunification of parents is only possible in limited cases:<\/p>\n<ul>\n<li>to underage German children: generally possible<\/li>\n<li>to underage foreign children: only in exceptional cases (e.g. with protection status)<\/li>\n<li>Reunification with skilled workers who received their first residence permit as a skilled worker after March 2023<\/li>\n<\/ul>\n<p>It is virtually impossible for parents to join their adult children. The only option is often <a href=\"https:\/\/www.jurati.de\/en\/migration-law\/family-reunification-with-eu-citizens\/\">reunification with another EU member state in accordance with EU law<\/a>.<\/p>\n<h3>Important requirements<\/h3>\n<ul>\n<li><strong>Entering<\/strong> the country <strong>with the correct visa<\/strong><br \/>\nThe residence permit is generally only issued if you have entered the country with a visa for family reunification; it is not usually possible to convert a Schengen visa into a residence permit.<\/li>\n<li><strong>Secured means of subsistence (depending on the case)<\/strong><br \/>\nParticularly necessary when joining foreign nationals.<\/li>\n<li><strong>No marriage of convenience<\/strong><br \/>\nThe authorities can check whether a genuine cohabitation is intended.<\/li>\n<\/ul>\n<h3>Typical problems in practice<\/h3>\n<ul>\n<li>Rejection of the visa by the embassy<\/li>\n<li>Doubts about the validity of the marriage<\/li>\n<li>Doubts about the intended marital partnership (accusation of sham marriage)<\/li>\n<li>Missing language certificates<\/li>\n<li>Problems with proof of livelihood<\/li>\n<li>Long duration of proceedings<\/li>\n<\/ul>\n<p>The procedures often take several months and require careful preparation.<\/p>\n<h3>Special feature: EU citizens<\/h3>\n<p>If you are joining an EU citizen, more favorable regulations often apply <a href=\"https:\/\/www.jurati.de\/en\/migration-law\/family-reunification-with-eu-citizens\/\">under EU law<\/a>.<\/p>\n<p>However, these regulations do not apply to reunification with German nationals.<\/p>\n<h3>Independent residence after separation<\/h3>\n<p>If you and your spouse have lived together for at least 3 years, you can obtain an independent residence permit.
