We will send you an invitation link for this purpose. Zoom acts for us as a processor pursuant to Art. 28 GDPR.

You can participate via the Zoom app or, without installation, via your browser. If you access Zoom’s website or use your own Zoom user account, Zoom is itself responsible for the associated data processing.

The following data is processed when you participate:

Personal details: the name you provide, email address, if applicable telephone number and profile picture,

Meeting metadata: topic, date, time and duration, meeting ID, IP address, device and hardware information, and, in the case of dial-in by telephone, the phone number,

Audio and video data: data from the microphone and camera of your end device during the call. You can switch both off yourself at any time,

Text data and files: your entries in the chat as well as shared screen content and documents.

To participate, you must provide at least a name.

We do not record video conferences. We create an automatic summary only with your express consent (see section 8).

The processing serves the purpose of conducting consultations and meetings. The legal basis is Art. 6(1) sentence 1 lit. b GDPR insofar as the conversation serves to initiate or perform an engagement agreement with you. Otherwise, in particular where there are additional participants in the conversation, the legal basis is Art. 6(1) sentence 1 lit. f GDPR; our legitimate interest lies in the effective conduct of online meetings. If special categories of personal data are discussed during the conversation, processing is carried out pursuant to Art. 9(2) lit. f GDPR for the establishment, exercise or defence of legal claims.

The content of the conversation is subject to lawyers’ professional confidentiality and is not disclosed to third parties. Zoom uses sub-processors to provide the service.

Zoom routes the call data via the data centre that offers the best connection for the participants. We have restricted the selection to data centres in Europe and the USA. For calls with participants in Europe, the content is generally processed in Europe; for participants in the USA, it is also processed there. Account and diagnostic data is processed by Zoom in the USA regardless. The transfer to the USA is based on the European Commission’s adequacy decision of July 10, 2023 on the EU-U.S. Data Privacy Framework (Art. 45 GDPR), under which Zoom is certified, and additionally on EU Standard Contractual Clauses (Art. 46(2) lit. c GDPR).

Audio and video data are processed only for the duration of the conversation. Zoom retains meeting metadata (participants, start, end, and duration) in reports for up to twelve months.

We save the chat history on our own systems after the conversation in order to be able to provide you with information shared there (e.g., links) at a later date. It is not stored by Zoom. We delete the chat history in accordance with the retention period pursuant to II.2.

Content stored after the conversation is placed in data centers within the European Union. Zoom retains meeting metadata (participants, start, end, and duration) in reports for up to twelve months. Insofar as we include conversation content in the client file, the retention period pursuant to II.2 applies.

If you do not wish to use Zoom, you can instead arrange a telephone or in-person appointment with us.

Further information can be found in the Zoom privacy notice.

8. AI-supported summary of video conferences

At your request, we can have an automatic summary of a video conference created. For this purpose, we use the “Meeting Summary” function of the Zoom AI Companion. The function is deactivated by default and is only started if all participants have expressly consented at the beginning of the conversation. During the creation process, Zoom displays a notice to all participants.

In this process, the spoken word of all participants is converted into a temporary transcript, from which a summary is generated by an AI language model. The content of the conversation is processed, including your details regarding the facts of the case, potentially special categories of personal data (e.g., health data, information on origin, religion, or political beliefs), data of third parties mentioned in the conversation, and meeting metadata. No audio or video recording takes place; the transcript is not stored by us.

The legal basis is your consent pursuant to Art. 6 Para. 1 Sentence 1 lit. a GDPR, and for special categories of personal data pursuant to Art. 9 Para. 2 lit. a GDPR. Consent is voluntary; without it, the conversation will take place as usual without a summary. You can revoke it at any time with effect for the future, including during the conversation. We will then terminate the function and, upon request, delete the summary generated up to that point.

The recipient is Zoom Video Communications, Inc. as a data processor (Art. 28 GDPR). We have configured Zoom so that only AI models operated by Zoom itself are used. According to Zoom, conversation content is not used to train AI models. Processing in the USA is possible; it is based on the adequacy decision of the EU Commission regarding the EU-U.S. Data Privacy Framework (Art. 45 GDPR), under which Zoom is certified, as well as supplementary standard contractual clauses.

The summary will be sent to you after the conclusion of the conversation and added to the client file. We delete it from the Zoom account after 30 days at the latest. In the client file, the retention period according to II.2 applies. The summary is generated automatically and may contain errors; it does not replace legal advice. Automated decision-making does not take place.

9. The transmission of data is encrypted. Access to the data is restricted to authorized persons who are subject to professional confidentiality.

The data is processed for the performance of the mandate agreement in accordance with Art. 6 para. 1 lit. b GDPR.
