{"id":3037,"date":"2018-02-14T14:07:45","date_gmt":"2018-02-14T13:07:45","guid":{"rendered":"https:\/\/www.jurati.de\/migration-law\/residence-permit-for-employment\/"},"modified":"2026-04-25T11:27:42","modified_gmt":"2026-04-25T09:27:42","slug":"residence-permit-for-employment","status":"publish","type":"page","link":"https:\/\/www.jurati.de\/en\/migration-law\/residence-permit-for-employment\/","title":{"rendered":"Residence permit for employment"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_custom_heading text=&#8221;Residence permit for employment&#8221; google_fonts=&#8221;font_family:Lora%3Aregular%2Citalic%2C700%2C700italic|font_style:400%20regular%3A400%3Anormal&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text 0=&#8221;&#8221; 1=&#8221;style=&#8220;color:&#8221; 2=&#8221;#000000;&#8220;&gt;&#8221;]The legislator has decided on numerous simplifications for the immigration of skilled workers.<\/p>\n<p><strong>Please check first whether you are eligible for an <a href=\"https:\/\/www.jurati.de\/en\/migration-law\/eu-blue-card\/\">EU Blue Card<\/a>.<br \/>\n<\/strong>If you do not reach the required income threshold or do not meet the qualification requirements, you have the following options for obtaining a residence permit for employment:<\/p>\n<h3><strong>Residence permit as a skilled worker <\/strong>(with recognized vocational training), \u00a7 18a and 18b AufenthG<\/h3>\n<p>You are considered a specialist if you<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>have at least 2 years <b>of vocational training or a degree, <\/b><\/li>\n<li>the vocational training or course of study is <strong>recognized<\/strong> as equivalent,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>You can find out whether a foreign <strong>university degree<\/strong> is recognized as equivalent on the <a href=\"http:\/\/anabin.kmk.org\" target=\"_blank\" rel=\"noopener noreferrer\"> information portal of the Standing Conference of the Ministers of Education and Cultural Affairs of the L\u00e4nder<\/a> in the Federal Republic of Germany<strong>(ANABIN database<\/strong>). If you cannot find your degree there, you can apply for an assessment by the <a href=\"https:\/\/www.kmk.org\/zab\/zentralstelle-fuer-auslaendisches-bildungswesen\/zeugnisbewertung.html\" target=\"_blank\" rel=\"noopener noreferrer\">Central Office for Foreign Education<\/a>. <\/p>\n<p>If you have a <strong>non-academic professional qualification<\/strong>, you can research the recognition body at <a href=\"http:\/\/www.anerkennung-in-deutschland.de\/\" target=\"_blank\" rel=\"noopener noreferrer\">www.anerkennung-in-deutschland.de<\/a>.<\/p>\n<p>As a skilled worker (with a recognized qualification), you can obtain a <strong>residence permit for employment <\/strong>if you<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>submit an offer for a job that requires a professional qualification (no auxiliary work)<\/li>\n<li>the <a href=\"http:\/\/www.arbeitsagentur.de\/arbeitsmarktzulassung\" target=\"_blank\" rel=\"noopener\">Federal Employment Agency<\/a> has confirmed that the salary for the specific position is customary for the location or in accordance with the collective agreement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>If you are abroad, your employer can obtain approval from the Federal Employment Agency before you apply for a visa in order to speed up the process or use the <strong>&#8220;accelerated skilled worker procedure&#8221;<\/strong>.<\/p>\n<h3><strong>Residence permit for employment without prior recognition of your qualification<\/strong><\/h3>\n<p>Have you completed at least two years of vocational training abroad and your training is recognized by the country in which you trained?<\/p>\n<p>You must first have this confirmed by the <a href=\"https:\/\/zab.kmk.org\/de\/dab\" target=\"_blank\" rel=\"noopener\">Central Office for Foreign Education <\/a>.<\/p>\n<p>You can then obtain a <strong>residence permit for &#8220;persons with practical work experience&#8221;<\/strong> (Sec. 19c AufentG, Sec. 6 BeschV) to work in your profession if you<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>have <strong>two years of experience<\/strong> in your profession and<\/li>\n<li>receive a gross annual salary of <strong>\u20ac 40,770<\/strong> or the employer is bound by a collective agreement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>If you do not yet have any professional experience, you can obtain a <strong>residence permit to carry out a recognition procedure<\/strong> (Sec. 16d AufenthG) if<span style=\"font-size: 1rem;\"> <\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>a German employer undertakes to pursue a recognition procedure after entry (<strong>&#8220;recognition partnership&#8221;<\/strong>) and<\/li>\n<li>you have German language skills at A2 level.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>If you have not yet found an employer, you can <span style=\"font-size: 1rem;\">obtain a <\/span><strong style=\"font-size: 1rem;\">job search opportunity card<\/strong><span style=\"font-size: 1rem;\"> (\u00a7 20a AufenthG). For this you will need <\/span> <\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>a professional qualification recognized abroad<\/li>\n<li>a confirmation from the <a href=\"https:\/\/zab.kmk.org\/de\/dab\" target=\"_blank\" rel=\"noopener\">Central Office for Foreign Education <\/a> <\/li>\n<li>German language skills at A1 level <em>or<\/em> English language skills at B2 level<\/li>\n<li>6 points awarded for your qualifications, language skills, professional experience, age and previous experience.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Skilled workers with university degrees recognized in Germany can immediately receive the Chancenkarte.<\/p>\n<p>You can carry out a self-check <a href=\"https:\/\/www.make-it-in-germany.com\/de\/visum-aufenthalt\/self-check-chancenkarte\" target=\"_blank\" rel=\"noopener\">here<\/a> to see whether you meet the requirements for the opportunity card.<\/p>\n<h3>Residence permit for employment for certain nationals regardless of qualifications<\/h3>\n<p>As a citizen of <strong>Australia, Israel, Japan, Canada, South Korea, Monaco, New Zealand, San Marino, Great Britain<\/strong> and the <strong>USA<\/strong>, you can be granted a residence permit for employment even if you cannot provide proof of a recognized professional qualification (Section 26 (1) of the Employment Ordinance). The prerequisite is that there are no domestic applicants available<strong>(priority check<\/strong>) and that the working conditions are in line with normal practice. As a national of one of the countries mentioned, you can also submit an application during a visiting stay.  <\/p>\n<p>As a national of <strong>Albania, Bosnia-Herzegovina, Kosovo, Macedonia, Montenegro<\/strong> and <strong>Serbia<\/strong>, you may be issued a visa to pursue gainful employment in (Section 26 (2) Employment Ordinance) if you<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>submit a concrete job offer,<\/li>\n<li>submit the application to the diplomatic mission or consular post in your home country,<\/li>\n<li>no domestic applicants are available<strong>(priority check<\/strong>),<\/li>\n<li>have not received any benefits under the Asylum Seekers Benefits Act in the last 2 years.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Residence permit <strong>for vocational training<\/strong><\/h3>\n<p>You may be granted a residence permit for <strong>in-company<\/strong> <strong>vocational training<\/strong>, \u00a7 16a AufenthG. You need a good knowledge of German to be able to follow the lessons at the vocational school. The training allowance must be appropriate and secure your livelihood.  <\/p>\n<p>The embassy also has discretionary powers. It may take into account whether you can complete the training more successfully.
